Access to and use of the site accessible at www.rpfinewines.com (hereinafter the "Site") implies tacit and unreserved acceptance of these conditions by the User, in their latest online version.

1. RP FINEWINES offers on the Site the sale and purchase of wines (hereinafter the "Products"), exclusively for individuals over 18 years, and legal entities not acting professionally.
RP FINEWINES is free to select the Products offered for sale on the Website and reserves the right to modify this selection at any time.
2. For any questions concerning the Products, the User is invited to contact the customer service department using the contact details given in article 5 hereof.
3. The order and sale of Products on the Site is subject to the free creation of a Customer account and validation of the Terms of Sale.
2. ACCESS AND AVAILABILITY
1. Access to the Site is free, and provided on a continuous and permanent basis, except in cases of force majeure or events beyond the control of the Publisher, and subject to any breakdowns and technical interventions, maintenance and updating necessary for the proper functioning of the Site.
2. Furthermore, due to the very nature of the Internet, the Publisher cannot guarantee that the site will operate 24 hours a day, 7 days a week.
3. LIABILITY
1. RP FINEWINES endeavours to offer to the Users the most reliable and qualitative information concerning the Products on sale on the Website, but does not guarantee the accuracy, timeliness and completeness of this information, nor the compliance of this information with the use that the Users wish to make of it.
2. Consequently, Users acknowledge that they use this information under their sole responsibility.
The Publisher may not therefore be held liable for any direct or indirect damage suffered by Users or third parties as a result of information published on the Site, or more generally as a result of consulting and using the Site.
3. The Publisher does not monitor sites linked to the Site via hypertext links and declines all responsibility for these sites and their content.
4. INTELLECTUAL PROPERTY
1 All data of any nature whatsoever, and in particular text, graphics, logos, icons, images, photographs, and in particular those representing and illustrating the Products, and in particular wine bottle labels, audio or video clips, trademarks, software and the characteristics of the Site appearing on the Site are necessarily protected by copyright, trademark law and all other intellectual property rights, and belong to the Publisher or to third parties having authorised the Publisher to use them.
Any unauthorised reproduction and/or representation of any nature whatsoever of any of the data referred to in this article constitutes an infringement and will be prosecuted.
2. The Publisher, in its capacity as publisher of the Site, grants the User a private, non-collective and non-exclusive right to use the data referred to in article 4.1 of these Terms and Conditions.
Under these conditions, the User undertakes not to reproduce, summarise, modify, alter or redistribute, without the express prior authorisation of the Publisher, any text, title, application, software, logo, image, graphic charter, brand, information or illustration, for anything other than strictly private use, which excludes any representation for commercial purposes or mass redistribution.
3. Any creation of a hypertext link from an Internet site to the Site must be expressly authorised in advance by the Publisher, and this authorisation may be withdrawn at any time by the Publisher, without having to justify its decision to do so.

6. CONFIDENTIALITY AND PERSONAL DATA
1. The Seller collects and processes the Customer's personal data and, where applicable, that of the recipient of orders concluded by the Customer in accordance with the legal requirements of the Data Protection Act of 6 January 1978 and the Data Protection Regulation (EU) 2016/679 of 27 April 2016 (GDPR).
2. The purposes, recipients, retention periods and conditions under which the Publisher collects and processes personal data, as well as the rights of data subjects in relation to such processing are precisely detailed in the "RP FINEWINES Personal Data and Cookie Management Policy".
7. MISCELLANEOUS
1. These conditions express the entirety of the obligations of the Publisher and the User.
RP FINEWINES reserves the right to unilaterally modify the terms of these Terms, in particular in case of technical, legal or jurisprudential developments, or when implementing new services.
The User is therefore advised to refer regularly to the latest version of the Terms of Use, which is permanently available via the "Terms of Use" link on the Site.
The new clauses will govern all future relations between the parties, and only the new version will prevail between them, the applicable conditions always being those accessible online on the Site.
2. In the event that any provision of these terms and conditions is held to be invalid by virtue of a present or future legal or regulatory provision, or by virtue of a court decision having the force of res judicata and emanating from a competent court or body, that provision of the contract shall be deemed to be unwritten, with all other provisions hereof retaining their binding force between the parties.
3. In the event of a dispute, only the French language version of these Terms of Use shall be deemed authentic for the purposes of interpretation.
These Terms of Use are governed by French law with regard to both content and form.
Any dispute arising from the performance or interpretation of the provisions of this contract shall oblige the parties to meet and attempt to find an amicable solution to their dispute, before bringing the matter before the competent court.
